As the Duluth News Tribune reported, Kosieradzki Smith Law Firm and our client will continue to seek punitive damages against 30-year-old Andrew Merzwski, who sexually assaulted our client, a resident of an assisted living facility, after giving her narcotics.
“Just because he chooses not to hire an attorney and is sitting in jail, doesn’t mean he’s not going to be held accountable in a civil suit,” the Duluth News Tribune quoted Mark Kosieradzki. “This has never been a thing about money. This is a case about holding Merzwski accountable.”
“If he’s held accountable, a message will be sent to Merzwski and any other potential sex abuser out there, and hopefully deter other sex abusers,” said Kosieradzki, “My hope is that the Minnesota Department of Health will look back at this and say, ‘Why did we miss this? What can we do in the future to protect vulnerable adults?’”
