Kosieradzki Smith pursues punitive damages for nursing home narcotic overdose

This past Monday morning, Joel Smith was in court in Austin, Minnesota, pursuing a punitive damages claim against the St. Mark’s Lutheran Home nursing home.  The case involves an overdose of Fentanyl (a potent narcotic). The Minnesota Department of Health (MDH) has completed its investigation of neglect concerns at St. Mark’s Lutheran Home in Austin, Minnesota. A complaint was filed with the Department alleging that St. Mark’s Lutheran Home’s nursing staff transferred a resident in a manner not in accordance with the resident’s care plan, resulting in a fracture to the resident’s left humerous.
